the Governor and State of Pennsylvania just argued to the Pennsylvania Supreme Court in the Kelly case, and the Supreme Court agreed, that laches should bar a constitutional challenge to the substance of a statute. That is the exact opposite of what the Governor and State “conceded” 22 years ago. So much for legal and political ethics. //
The voters of Pennsylvania are given a meaningful and necessary role in amending their State’s constitution. A vote of a majority of the electors in a general election is the required final step to adoption of such amendments. The Defendants in the Kelly complaint deprived the Electors of their right to validate the proposed amendment passed by the General Assembly, and they put the amendment in place without their approval.
That was “disenfranchisement” of the Pennsylvania electorate. Who is to say that Pennsylvania voters might have rejected “no excuse” mail-in balloting if not for being disenfranchised.

When Kyle Becker heard about the "glitchy" computer program in Antrim County, Michigan, the one that tried to give 6,000 Trump votes to Biden, he started doing research into the system. Earlier on Saturday the Pennsylvania Supreme Court issued a short decision ordering dismissal of the complaint filed by Congressman Mike Kelly and seven others challenging the legality of “no excuse” mail-in voting adopted by the Pennsylvania Legislature. The complaint alleged that such a system violated express provisions of the Pennsylvania Constitution, which require in-person voting subject only to very limited exceptions for “absent electors” within four very narrow classes.
The Pennsylvania Supreme Court did not address the merits of the allegations. It dismissed the complaint solely on the equitable doctrine of “laches,” which can be applied when one party to a dispute is seen by the Court as having “sat on its rights” with regard to a legal claim, and the opposing party would be unfairly injured to allow the party asserting its rights to prevail after having failed to act when it was first aware of the claim. //
But here are a couple questions to consider when taking into account of the language used by the Pennsylvania Supreme Court:
The defendants and allegedly bad actors in the allegations of the Complaint are Pennsylvania state officials. How are they injured here?
What does the application of the “doctrine of laches” do to vindicate their interest?
What interests do they have in operating a facially invalid election scheme?
What interests do the voters of Pennsylvania have in maintaining a facially unconstitutional voting scheme?
And, as the Chief Justice of the Court made clear in his partial concurrence and partial dissent:
“laches and prejudice can never be permitted to amend the Constitution.” Sprague v. Casey, 520 Pa. 38, 47, 550 A.2d 184, 188 (1988) //

Another case of circular reasoning. Prior to this election you could not sue because you could not show harm. Today after you have been harmed you cant sue because you didn't previously sue.
Trump got 11 million more votes than when he won in 2016, receiving more votes than any incumbent running for re-election. //
Bellwether states like Florida, Ohio and Iowa went more to Trump than they had in 2016. Usually the Rust Belt states would go with Ohio as they had in 2016. As Basham notes, there have only been one who “lost” the Electoral College after winning those three states since 1852 – Richard Nixon in 1960 but that’s when there was a lot of question about “help” received by John Kennedy.
Moreover while there were spikes in exactly the cities that Biden needed in the critical swing states, there weren’t comparable spikes in comparable cities. Because while Biden supposedly won more votes than anyone in history (despite not being able to get out people to fill his circles in anemic events), he “won a record low of 17 percent of counties; he only won 524 counties, as opposed to the 873 counties Obama won in 2008.” But supposedly had more total votes. What that says is the increase was where it needed to be, not across the board, in what one would have to say was very unusual.
As I’ve written before, the non-polling metrics had all been going to Trump including party registrations trends; the respective primary votes; candidate enthusiasm; social media followings; broadcast and digital media ratings; online searches; the number of (especially small) donors; and the number of individuals betting on each candidate. So you would have to believe that all these historically accurate measures all suddenly were wrong to believe that Trump lost.

In Georgia, Biden overtook Trump with 89 percent of the votes counted. For the next 53 batches of votes counted, Biden led Trump by the same exact 50.05 to 49.95 percent margin in every single batch. It is particularly perplexing that all statistical anomalies and tabulation abnormalities were in Biden’s favor.

It was clear that the Democrats were going to employ all means necessary to win the election. Why Trump could not put together a disciplined team to monitor and later to contest the election will probably have to wait for the books and "insider" leaks, but I suspect it was a combination of Trump being a mercurial employer who is quick to turn against people working for him scaring people away coupled with a desire not to be the target of retribution from the Deep State and the cancel culture and threats from the media and various shadow groups.
And also not wanting to be at Ground Zero if we end up with a Biden/Harris administration.

Philadelphia's top election official is warning that thousands of mail-in ballots could be thrown out in November unless changes are made to rules around "secrecy envelopes" -- second sleeves that help prevent poll workers from seeing how someone voted.
The Pennsylvania Supreme court ruled last Friday that officials can reject so-called naked ballots that are received without the secrecy envelope. State election officials had previously provided guidance telling counties to count naked ballots.
Based on error rates in previous elections, that could mean more than 100,000 mail-in ballots are at risk, according to Philadelphia city commissioner Lisa Deeley.
Deeley wrote a letter Monday to Republican state House Speaker Bryan Cutler and Republican state Senate President Joseph Scarnati, calling for urgent legislative action to eliminate the secrecy sleeve requirement.
She argued that the requirement could cause the state to be the "subject of significant post-election legal controversy, the likes of which we have not seen since Florida in 2000." //
Cutler spokesman Mike Straub said there's no plan to change the requirement.
"The Supreme Court was very, very clear in their ruling that the secrecy envelopes served an important purpose in ensuring the confidentiality of every ballot," said Straub. "The court has really made that official. We really don't have any plans to take that up again."
In its first court victory, a Nevada judge has agreed to let the Trump campaign present its evidence that fraud and illegalities plagued the state’s election, enough to reverse Joe Biden's win and set an example for other state challenges.
According to Trump officials, the judge set a Dec. 3 hearing date and is allowing 15 depositions. What’s more, the campaign plans to present its evidence that could result in the rejection of tens of thousands of mail-in ballots in Democratic Clark County where Biden ballots outnumbered Trump ballots by 91,000 in unofficial results. //
But its biggest claim was that the signatures on hundreds of thousands of mail-in ballots were not verified by human officials, as required by law.
What’s more, they found that officials used a machine to verify signatures, apparently against the rules, and even those machines were plagued with problems.
Another legislator testified about spikes in the vote that he called “a prime indicator of fraudulent voting.” Of 604,000 votes, roughly 570,000 went for Biden and only 3,200 went for Trump. Listen to the reaction of the audience when they hear this. //
Pennsylvania State Rep. Mike Jones (R-York) spoke about the difference between voter registration changes and the vote margins in the official election results. He noted that Republicans had a 680,000 voter registration margin on Election Day in Pennsylvania, yet Trump lost by 90,000 votes. Jones admitted that such a result was “not impossible” but extremely fishy, nonetheless.
He noted that in York County, Republican voter registrations increased by 13,000 but Trump’s margin of victory in the county actually decreased from 2016. //
According to the preliminary results, Biden won 80 million votes — more than 15 million more than Obama received in 2012. He did this despite losing almost every bellwether county to Trump. He also underperformed Hillary Clinton’s 2016 totals in every urban county in the United States except the metropolitan areas of Georgia, Michigan, Wisconsin, and Pennsylvania. Biden won despite Democrats losing in contested races for the U.S. House and state legislatures. Biden also defeated Trump despite the president’s historically huge margins in the GOP 2020 primaries.
The country continues to balance on a knife’s edge as we await the outcome of the presidential election (and a few down-ballot races, too). What the Democrat-media complex would have us believe is that the absentee candidate Joe Biden received more votes for president than anyone in American history, including millions more than either Hussein Obama (twice) and Hillary Clinton. And Biden supposedly also turned American political history on its head by defeating an incumbent president while his Democrat Party lost seats in the US House of Representatives (not to mention other down-ballot disasters for Democrats in state and local elections).
The current Democrat-media narrative avoids any discussion of those anomalies, as well as that of “The Great Pause” for 3-4 hours on Election Day night when Biden supposedly made up deficits of hundreds of thousands votes in key swing states while most Americans went to bed believing that President Trump had been easily reelected. Their narrative is that “the election is over, Biden has been ‘declared’ the winner, and President Trump must concede and initiate an orderly transition to the inevitable Biden-Harris regime.”
Or, the alternate view is that the Democrats stole the election through massive and blatant voter fraud using every trick in the book: ballot harvesting, fraudulent/machine-printed and stamped mail-in ballots, tossing ballots marked for President Trump, automated vote-switching by Democrat-controlled ballot marking devices in wide use in swing states, etc. That view has been fortified by hundreds of personal affidavits detailing observed instances of voter fraud, statistical data analysis of “The Great Pause” that exposed the virtual impossibility of Biden’s late-night vote gains (for example, in Pennsylvania as reported here), much reporting about potential fraud through use of Dominion Voting systems in key states, and even complete denials of voter fraud by the Democrat-media complex despite significant circumstantial evidence that continues to be made public (possibly

Boockvar also exceeded her authority by granting private, partisan organizations—including the notoriously pro-Democrat group “Rock the Vote”—access to the Commonwealth’s Statewide Uniform Registry of Electors (SURE).
“Rock the Vote’s web tool was connected to our system, making the process of registering voters through their online programs, and those of their partners, seamless for voters across Pennsylvania,” the lawsuit quotes Boockvar as saying.
That’s not supposed to happen. It’s one thing for outside groups to submit registration applications to the state on behalf of would-be voters, but election clerks are the only ones who are supposed to enter this sort of information directly into the records.
It’s easy to see why by inspecting post-election voter lists, which contain names such as “Mary April Smith,” followed by “Mary May Smith,” “Mary June Smith,” “Mary July Smith,” and so forth through the rest of the calendar. When the same voter lists were purchased just a week later, however, those suspicious names had mysteriously disappeared from the rolls.

A new report from the Media Research Center shows that the media’s lack of coverage and big tech’s suppression of certain issues and scandals surrounding Democratic Presidential Nominee Joe Biden could have cost President Donald Trump the election.
The survey results report that 17 percent of Biden voters would not have voted for the Biden-Harris presidential ticket if they had known about at least one of the eight news stories that were suppressed by big tech and mainstream media outlets. //
Some of these topics include former Biden staffer Tara Reade and her sexual assault allegations against Biden, the Hunter Biden scandal, VP Nominee Kamala Harris’s extreme liberal voting record in the Senate, the U.S.’s economic jump in the third quarter, millions of jobs added, America’s energy independence, Operation Warp Speed successes, and Trump’s facilitation of multiple peace deals in the Middle East. //

One in six Biden voters polled, 17 percent, said they would have changed their vote had they been aware of these stories. Noncitizens likely voted at a high enough rate to alter the 2020 Electoral College tally, potentially flipping the states of Arizona and Georgia in the presidential election, according to an analysis by Just Facts, a research group.
