Authorities at an airport last year seized a bag of cash that Kermit Warren was carrying to buy a truck. It was his life’s savings but prosecutors contended the money was linked to drugs. //

The seizure, on Nov. 4, 2020, led to a yearlong ordeal that highlighted what Mr. Warren’s lawyers call the injustice of civil forfeiture, which allows law enforcement officials to seize the cash, cars or other personal property of people suspected of crimes but not charged.

The practice is a popular way to raise revenue but has been easily abused and widely criticized for depriving people of their right to due process and for disproportionately affecting poor people and people of color like Mr. Warren, who is Black. //

On Thursday, federal prosecutors agreed to return all $28,180 to Mr. Warren and to dismiss their civil forfeiture complaint “with prejudice,” which means that it cannot be refiled, Mr. Alban said.

In the agreement, prosecutors did not admit any wrongdoing. Prosecutors and the D.E.A. did not respond to emails seeking comment on Saturday.

What speech should be protected by the First Amendment is open to debate. Americans can, and should, argue about what the law ought to be. That’s what free people do. But while we’re all entitled to our own opinions, we’re not entitled to our own facts, even in 2019. In fact, the First Amendment is broad, robust, aggressively and consistently protected by the Supreme Court, and not subject to the many exceptions and qualifications that commentators seek to graft upon it. The majority of contemptible, bigoted speech is protected. //

American courts don’t balance the benefits and harms of speech to decide whether it is protected—they look to whether that speech falls into the First Amendment exceptions noted above. As the Supreme Court recently explained, the “First Amendment’s guarantee of free speech does not extend only to categories of speech that survive an ad hoc balancing of relative social costs and benefits. The First Amendment itself reflects a judgment by the American people that the benefits of its restrictions on the Government outweigh the costs. Our Constitution forecloses any attempt to revise that judgment simply on the basis that some speech is not worth it.”

An attack attempt in 2020 proves the UAS threat is real—and not enough is being done to stop it.

In July of last year, a DJI Mavic 2 drone approached a Pennsylvania power substation. Two 4-foot nylon ropes dangled from its rotors, a thick copper wire connected to the ends with electrical tape. The device had been stripped of any identifiable markings, as well as its onboard camera and memory card, in an apparent effort by its owner to avoid detection. Its likely goal, according to a joint security bulletin released by DHS, the FBI, and the National Counterterrorism Center, was to “disrupt operations by creating a short circuit.”

The drone crashed on the roof of an adjacent building before it reached its ostensible target, damaging a rotor in the process. Its operator still hasn’t been found. According to the bulletin, the incident, which was first reported by ABC, constitutes the first known instance of a modified, unmanned aircraft system being used to “specifically target” US energy infrastructure. It seems unlikely to be the last, however.

There were around 1.5 million deer claims for the industry between July 1, 2019, and June 30, 2020. State Farm also advised not to swerve or veer off the road for the deer but to instead just slow down. In fact, State Farm has a full list of helpful tips:

Stay alert. Pay attention to “deer crossing” and other signs and be cautious in areas near woods or water.

Use high beams. Flicking your high beams on a deer in the road may cause the animal to scurry away. High beams also help illuminate dark roads.

Don’t swerve. If an animal-car crash is inevitable, maintain control of your vehicle and don’t veer off the road.

Brake as necessary. If you can avoid hitting the animal, reduce your speed, honk your horn and tap your brakes to warn other drivers. If there are no drivers behind you, brake hard.

Remember peak season. Deer crashes happen most during October through December, which is hunting and mating season. Collisions are most likely to happen in West Virginia, Montana, Pennsylvania and South Dakota.

Remember meal time. Watch for animals in the road between dusk and dawn.

Watch for herds. If you see one deer, there are probably more nearby.

Don’t rely on a whistle. No scientific evidence supports that car-mounted deer whistles work.

Wear seat belts. Always obey speed limits and wear seat belts.
