NY Supreme Court Delivers a Beat Down to the New York Times in Project Veritas Case – RedState

BREAKING: NY Supreme Court GRANTS Veritas’ Motion; ORDERS New York Times to destroy attorney-client memos “irregular[ly]” obtained from PV; REJECTS Times’ cries of “prior restraint” while citing case about “‘Hit and run’ journalism”

How did NYT obtain the memos? Poss. "improper means" : "The Times incredibly admitted that here 'no apparent bribery was used to obtain the memoranda.' ... [PV] has met its burden of showing [the memos] were obtained by irregular means, if not both irregular and improper means."

But the memos were public concern because it involved PV, no? No: "[S]ome things are not fodder for public consideration and consumption. These memoranda ... are only between an attorney and a client, and it does not matter one bit who the attorney and client are."

The Times/corp. media argued prior restraint. Wrong. "The Times is perfectly free to investigate, ... publish, opine, expose or ignore whatever aspects of Project Veritas its editors in their sole discretion deem newsworthy, without utilizing [PV's a/c] privileged memoranda."

"[T]he court's protective order does not act as an impermissible prior restraint on the Times. As important as the First Amendment's protection against prior restraints is, on the present facts, the erosion of the attorney-client privilege is a far more imminent concern."

Of the Times' journalism, the court noted: ... "''Hit and run' journalism is no more protected under the First Amendment, than speeding on a crowded sidewalk is permitted under a valid driver's license.'" #ouch.

"[T]his is no defeat for the First Amendment," wrote the Court. "It would indeed be a Pyrrhic victory...if the Amendment's safeguarding of the media... were confused with the attempt to constitutionalize the publication of the private, privileged communication ...presented here."

A hard-fought victory by the indefatigable @libbylocke of @ClareLockeLLP, who frequently reminds the NYT that, contrary to internal belief, they are not the most powerful entity in the State of New York.

Elon Musk said his wealth "isn't some deep mystery" and that his taxes are "super simple."
He told The Babylon Bee he doesn't use tax-avoidance schemes, offshore accounts, or tax shelters.
The tech billionaire recently clashed with Warren, who accused him of "freeloading" over taxes. //

Musk, who now tops the Bloomberg Billionaires Index with a net worth of $261 billion, told The Babylon Bee that he could do his taxes himself "in a few hours." //

He said his worth was calculated by multiplying his ownership percentage of the two companies by their valuations.

"My so-called wealth, it's not some deep mystery," Musk said.

He added that he doesn't take salaries or bonuses from the companies because he thought it would be "morally good to not do that."

"My cash balances are very, very low, at least until I sold stock," Musk said. "I simply had loans against my stock, so if Tesla and SpaceX went bankrupt, I would go bankrupt too, immediately."

Musk has sold $15.4 billion in Tesla shares since asking Twitter on November 6 to vote on whether he should divest 10% of his stake, and said Wednesday that he was "almost done" selling stock. He told The Babylon Bee that this quarter was the first time he sold stock "in any meaningful way."

Some may quibble with my use of the word “rigged,” but I think it’s more than apt. The Democrats’ legislation not only bans voter ID laws that are key to election security, but it also endorses ballot harvesting, uses taxpayer money to fund political campaigns, mandates same-day registration with no safeguards, makes mail-in voting universal, automatically registers minors, legalizes so-called “drive-thru” voting, and even sets up a system where ballots are allowed to be counted if they arrive 10 days after an election.

There is simply no justification for passing an illegitimate power grab over the nation’s election systems, and in my opinion, no justification could ever exist in any circumstance. We are a republic, and localized control of elections is a bedrock principle of our system. //

If you can make an exception on “voting rights,” one can be made on anything. Oh yeah, and lest we forget, Democrats would like to pack the Supreme Court as well. You know, to save “democracy” or some such.

This is all really tyrannical stuff, and if the shoe was on the other foot, the gnashing of teeth from the press would never cease. Yet, instead of being condemned, Democrats are actually lauded for their dictatorial efforts. It’s absolute insanity.

The budget-reconciliation process allows a simple majority to pass legislation, but it comes with a price: unlimited amendments. Despite Democrats’ efforts to claim just “one senator” stands against their bill, the actual number is 51—Mr. Manchin and the 50 Republicans. Imagine what fun that majority could have in a vote-a-rama.
Mr. Manchin could craft amendments striking entire entitlements from the bill, amendments barring climate programs, amendments gutting the bill’s tax hikes.
